Terms of Service
Please read these Terms of Service ("Terms") before using myfolkherbal.com ("Website"), using any of its features, or purchasing a subscription. These Terms govern your use of the Website and form a legally binding agreement between you ("you", "User") and the operator of the Website ("we", "us", "our").
If you have not read or do not agree with these Terms, please stop using the Website and do not make a purchase.
1. General information
1.1. MyFolkHerbal is a trading name used to operate this Website. When you purchase a subscription, you enter into a contractual relationship with us, governed by these Terms and applicable law.
1.2. To use the Website and purchase a subscription, you must:
(a) have read these Terms and agree to be bound by them;
(b) be at least 18 years old, or of legal age to enter into a distance contract in your country, whichever is higher;
(c) be purchasing for your own personal use, and not on behalf of a business or for resale.
1.3. The Website is intended for adults only. It is not designed for and must not be used by children or minors.
1.4. We may prohibit you from accessing the Website if we have reasonable grounds to believe you do not meet the requirements in Clause 1.2, or that you are in breach of any other provision of these Terms.
2. What we provide
2.1. We provide a digital subscription to a personalised library of traditional herbal preparations ("Service", "Library").
2.2. You answer a questionnaire about your interests and how you have been feeling. Based on your answers, we assemble a selection of recipes from our library and make them available to you through your account.
2.3. The Service is entirely digital. There is no physical product, no printed book, and nothing is shipped to you.
2.4. The recipes describe preparations as they have traditionally been made and used. They are provided for general interest and educational purposes only. They are not medical advice, not a treatment for any condition, and not a substitute for consultation with a doctor, pharmacist or other qualified healthcare professional.
2.5. We do not claim that any recipe will prevent, treat, cure or alleviate any disease, illness or medical condition. Any decision to prepare or consume anything described on the Website is yours alone, made at your own risk.
2.6. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable licence to access and use the Library for your own personal use.
2.7. The contents of your Library are selected from our recipe collection based on the answers you give. You may retake the questionnaire at any time to replace your selection. We may add, revise, correct or withdraw recipes at any time, including for safety reasons. The specific recipes in your Library may therefore change during your subscription.
2.8. We do not guarantee that any particular recipe will appear in your Library, or remain in it.
3. Health and safety
3.1. Plants are chemically active. Some interact with prescription and over-the-counter medicines, some are unsuitable during pregnancy or breastfeeding, and some are unsuitable for people with particular medical conditions or allergies.
3.2. Before preparing or consuming anything described on the Website, you should speak to a doctor or pharmacist if you are pregnant, breastfeeding, taking any medication, managing a health condition, or preparing something for another person.
3.3. Each recipe includes notes on what to watch for. You are responsible for reading those notes before use, and for correctly identifying any plant material you obtain. Some plants have toxic look-alikes.
3.4. You are responsible for sourcing your own ingredients and for their quality, identity and suitability. We do not supply ingredients and are not responsible for anything you buy from a third party.
3.5. If you experience an adverse reaction, stop immediately and seek medical advice.
4. Accounts
4.1. To access your Library you must create an account with a valid email address and a password.
4.2. You are responsible for keeping your password confidential and for all activity under your account. Do not share your login details.
4.3. Your account is for your personal use only. You may not sell, share, transfer or provide access to it to anyone else.
4.4. We may suspend or terminate your account if we reasonably believe it is being shared, resold, or used in breach of these Terms. Where we do so because of a breach, no refund is due.
4.5. Tell us promptly at info@myfolkherbal.com if you believe your account has been accessed without your permission.
5. Pricing and payment
5.1. Current prices and subscription terms are shown on the checkout page before you pay.
5.2. Payments are processed by Stripe. We do not receive or store your full card details. See our Privacy Policy for how payment data is handled.
5.3. By placing an order, you authorise us and our payment processor to charge the total amount due to your chosen payment method.
5.4. All prices are in US dollars. The price you see is the price you pay. We do not add tax at checkout.
5.5. An electronic receipt is made available after each successful payment.
6. Subscriptions, free trial and pricing
6.1. Access to the recipe library is sold as a subscription. You choose the billing period when you subscribe.
6.2. Every new customer gets a 7 day free trial. We collect your card details when you sign up, but we do not charge them during the trial. The trial begins the moment you subscribe.
6.3. Nothing is charged until the trial ends. Your first payment is taken on day 8, at the introductory price for the plan you chose. Every payment after that is at the standard price.
6.4. The prices are:
| Plan | Free trial | First payment | Every payment after |
|---|---|---|---|
| Monthly | 7 days | $6.94 | $19.99 per month |
| Quarterly | 7 days | $16.94 | $59.97 per quarter |
| Six monthly | 7 days | $26.94 | $119.94 per six months |
| Annual | 7 days | $39.94 | $239.88 per year |
All prices are in US dollars. The price shown is the total you pay.
6.5. The introductory price applies to your first payment only. We show you the exact date and the exact amount of that payment before you confirm, and again in an email three days before it is taken.
6.6. One free trial per person. The free trial is for customers who have not subscribed to My Folk Herbal before. If you have subscribed before, on any plan, you subscribe at the introductory price with no trial period.
6.7. Your subscription renews automatically at the standard price until you cancel it. We will tell you by email before any price change takes effect.
6.8. If a payment fails, access to the library stops immediately. We will retry the payment, and we will tell you when. You can update your card at any time from your account page, which charges the outstanding amount straight away and restores access.
7. Cancellation and refunds
7.1. Cancelling during the free trial costs you nothing. Cancel before the trial ends and no payment is ever taken. Access stops at the moment you cancel.
7.2. Cancelling after you have paid. You can cancel at any time from your account. Access to the library ends immediately when you cancel.
7.3. Because access ends immediately rather than at the end of the period you have paid for, we do not refund the unused part of that period automatically, and there is no option to pause or downgrade instead.
7.4. The 30 day guarantee. Separately from 7.3, if you are not happy with the library within 30 days of your first payment, write to us at info@myfolkherbal.com and we will refund that payment. We ask you to write to us because we would like the chance to understand what was wrong. You do not have to give a reason, and we will not try to talk you out of it.
7.5. The guarantee in 7.4 covers your first payment on a plan, once. It does not cover later renewals, and it does not apply again if you subscribe a second time.
7.6. Deleting your account cancels any active subscription and ends access immediately.
8. Access and payment
8.1. When access begins. Access to the library begins as soon as you subscribe, which for a new customer is at the start of the free trial, before any payment is taken.
8.2. What you are buying. A subscription is access to digital content for the period you have paid for. Nothing is shipped to you, and there is nothing to return.
8.3. Refunds. Refunds are governed by clause 7. Where clause 7 does not provide for a refund, payments already taken are not refunded.
8.4. Your right to cancel. You can cancel at any time, from your account, with no notice period and no cancellation fee. Clause 7 sets out what happens to your access and your payments when you do.
8.5. If you believe you have been charged in error, write to us at info@myfolkherbal.com and we will look into it.
9. Your obligations
9.1. By agreeing to these Terms you confirm that:
(a) you are at least 18 years old;
(b) the contact, billing and personal information you provide is true and correct;
(c) you are paying with a card that belongs to you, or that you have the cardholder's authorisation to use;
(d) you are purchasing for personal use only.
9.2. You may not use the Service for any unlawful purpose, or in a way that breaches any applicable law.
9.3. You acknowledge that the Website may not be available at all times, including during maintenance.
10. Our rights
10.1. We are not responsible if information on the Website is inaccurate, incomplete or out of date. Reliance on it is at your own risk.
10.2. We do not warrant that the Service will be uninterrupted or error-free, and we are not responsible for interruptions, system failures or other events affecting access.
10.3. We may refuse or cancel an order and reject a payment where we have reasonable grounds to believe that:
(a) the Service is being purchased for commercial use, resale or third-party use;
(b) the purchaser is under 18;
(c) the purchase is fraudulent or the payment method is not authorised.
10.4. We may modify, suspend or discontinue the Service. Where we discontinue it entirely, we will give reasonable notice and refund the unused portion of any prepaid term.
11. Intellectual property
11.1. All content on the Website and within the Library — including recipe text, photographs, design, layout, logos and trademarks — is owned by us or licensed to us.
11.2. You may not reproduce, copy, republish, distribute, sell, lend, transmit or make available any part of the Library, in whole or in part, without our prior written consent.
11.3. You may print or save individual recipes for your own personal use. You may not distribute them, publish them, or share them publicly or with others.
11.4. Nothing in these Terms transfers any intellectual property right to you. You receive only the limited licence described in Clause 2.6.
11.5. If you breach this section we may suspend or terminate your access without refund, and recover any loss we suffer as a result, including costs.
12. Personal data
12.1. We process your personal data in accordance with our Privacy Policy, which forms part of these Terms.
12.2. Your questionnaire answers are used to assemble your Library and are deleted once it has been built. We retain the resulting list of recipes so that your Library opens each time you sign in. Please read the Privacy Policy before answering.
13. Disclaimers and limitation of liability
13.1. TO THE FULLEST EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL LOSS OR DAMAGE ARISING FROM YOUR USE OF, OR INABILITY TO USE, THE WEBSITE OR THE SERVICE, INCLUDING ANY LOSS ARISING FROM YOUR PREPARATION OR CONSUMPTION OF ANYTHING DESCRIBED IN THE LIBRARY.
13.2. THE SERVICE IS PROVIDED FOR GENERAL INTEREST AND EDUCATIONAL PURPOSES ONLY. WE ARE NOT RESPONSIBLE FOR ANY LOSS OR HARM RESULTING FROM ITS USE FOR ANY OTHER PURPOSE.
13.3. WE DO NOT WARRANT THAT THE WEBSITE OR ITS CONTENT WILL BE AVAILABLE AT ALL TIMES, UNINTERRUPTED OR ERROR-FREE.
13.4. WE MAKE NO REPRESENTATION OR WARRANTY AS TO THE ACCURACY, COMPLETENESS, TIMELINESS OR RELIABILITY OF ANY CONTENT ON THE WEBSITE.
13.5. Some jurisdictions do not allow the exclusion or limitation of certain damages. In those jurisdictions our liability is limited to the greatest extent permitted by law.
13.6. Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud, or for any other liability that cannot lawfully be excluded.
13.7. The Website may link to third-party websites. We do not control those sites and are not responsible for their content. You access them at your own risk.
14. Reviews and testimonials
14.1. Where we display customer reviews or testimonials, we may use a first name or initials only, to protect the privacy of the person who provided them.
14.2. Reviews are moderated. We may decline to publish or may remove reviews that contain offensive language, personal data, unverifiable claims, or statements that could be read as medical advice.
15. Governing law and disputes
15.1. If you have a complaint, please contact us first at info@myfolkherbal.com. We will do our best to resolve it promptly.
15.2. These Terms are governed by the laws of the Republic of Lithuania.
15.3. If you are a consumer, this choice of law does not deprive you of the protection of any mandatory consumer protection rules of the country in which you habitually reside, and you may bring proceedings in the courts of that country.
15.4. If you are a consumer in the EU, you may also use the European Commission's Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.
16. Changes to these Terms
16.1. We may update these Terms. The current version is always available on this page, with the date it was last updated shown at the top.
16.2. Where changes materially affect your rights, we will notify you by email before they take effect.
16.3. Continuing to use the Service after changes take effect means you accept the updated Terms.
17. Miscellaneous
17.1. If any provision of these Terms is found unlawful, void or unenforceable, that provision shall be severed and the remaining provisions shall remain in full force.
17.2. You may not transfer or assign your rights or obligations under these Terms without our prior written consent. We may transfer or assign these Terms at any time.
17.3. Our failure to enforce any provision is not a waiver of that provision.
